What the Law Says

UK law is clear on child car seats.

  • Children must use an appropriate car seat until they're 12 years old or 135cm tall (whichever comes first).
  • After that, they must wear a seatbelt like an adult.
  • Children under 3 must always be in a car seat. No exceptions.
  • The driver is legally responsible for ensuring all passengers under 14 are properly restrained.

Which Seat for Which Age?

Important: These are general guidelines. The new i-Size regulation (UN R129) uses height rather than weight to determine the right seat. Check the seat's label for height and weight limits.


Rear-Facing vs Forward-Facing

This is one of the most important safety decisions.

  • Rear-facing is safest. In a front-on collision, it supports the child's head, neck, and spine.
  • Keep children rear-facing as long as possible. The law requires rear-facing until at least 15 months (under i-Size rules).
  • Many safety experts recommend rear-facing until age 4 if the seat allows it.

Forward-facing seats are fine once the child outgrows the rear-facing limit. But don't rush the switch.


ISOFIX Explained

ISOFIX is the safest way to fit a child seat in your car.

  • ISOFIX uses built-in anchor points in the car to hold the seat firmly in place.
  • It reduces the risk of incorrect fitting. Studies show up to 60% of seatbelt-fitted seats are installed wrongly.
  • Most cars made after 2012 have ISOFIX points as standard.
  • Check your car's handbook to find where the ISOFIX points are.

Common Car Seat Mistakes

  1. Seat too loose: It shouldn't move more than 2.5cm side to side. Check it's firmly fitted.
  2. Harness too slack: You should only be able to fit one finger between the harness and your child's chest.
  3. Switching to forward-facing too early: Keep rear-facing as long as the seat allows.
  4. Moving to a booster too soon: Children under 4 should be in a full car seat with a harness, not a booster.
  5. Using a second-hand seat without checking: Never use a seat that's been in an accident. Check for damage and expiry dates.
  6. Putting the seat on a seat with an active airbag: Never put a rear-facing seat in the front if there's an active airbag. It can be fatal.

Exceptions to the Rules

There are a few situations where the rules are slightly different.

  • Taxis and private hire vehicles: Children under 3 can travel without a car seat in the back of a licensed taxi if no seat is available. Children over 3 must use an adult seatbelt.
  • Unexpected journeys: If a car seat isn't available for an unexpected short journey, children over 3 can use an adult seatbelt in the rear seats only.
  • Medical exemptions: Some children are exempt on medical grounds with a doctor's certificate.

Penalties for Not Using a Car Seat

The fines are significant.

  • Fixed penalty: £500 fine.
  • No penalty points (currently), but the fine is enough of a deterrent.
  • The driver is responsible: Even if the child isn't yours, if you're driving, it's your responsibility.

The right car seat can save your child's life. Make sure you have the correct one for their age, height, and weight. Fit it properly using ISOFIX where possible. And keep them rear-facing as long as you can.
