Parking Fines in the UK: Your Rights and How to Appeal

Summary

  • Council parking tickets (PCNs) and private parking charges are different: Council fines carry legal weight. Private charges are invoices — you have more rights to dispute them.
  • You can appeal any parking fine: Many people succeed, especially if the signage was unclear or the ticket was issued incorrectly.
  • Act quickly: Council PCNs are discounted 50% if paid within 14 days. See our parking fine appeal guide for the full process.

Parking fines are frustrating. But many are issued incorrectly or unfairly. Knowing your rights can save you money.

Types of Parking Fines

Council Penalty Charge Notices (PCNs)

Issued by local councils for:

  • Parking on yellow lines
  • Overstaying in council car parks
  • Parking in bus lanes or loading bays
  • Not paying the parking meter

Fines are usually £50–£70 (50% discount if paid within 14 days). In London, fines are higher: £80–£130.

Private Parking Charges

Issued by private companies (like ParkingEye, Euro Car Parks, APCOA) for:

  • Overstaying in supermarket or retail car parks
  • Not displaying a ticket
  • Entering without paying

These are NOT fines. They are invoices for breach of contract. The maximum charge is usually £100.

How to Appeal a Council PCN

  1. Check the ticket carefully: Look for errors in the date, time, location, or car registration. Any mistake can invalidate it.
  2. Make an informal challenge: Write to the council within 14 days explaining why the ticket is wrong. Include photos if possible.
  3. If rejected, make a formal representation: You have 28 days to submit this after receiving the Notice to Owner.
  4. Appeal to the independent tribunal: If the council rejects your formal representation, you can appeal to the Traffic Penalty Tribunal (England/Wales) or the Parking and Bus Lane Tribunal (Scotland).

How to Appeal a Private Parking Charge

  1. Don't ignore it: Since the Supreme Court ruling in 2015, private parking companies can pursue charges through the courts.
  2. Appeal to the company first: Explain why the charge is unfair. Include evidence.
  3. Escalate to POPLA or IAS: If the company is a member of the BPA (British Parking Association), appeal to POPLA. If they're IPC members, appeal to IAS.

Common Reasons Appeals Succeed

  • Unclear signage: If the parking rules weren't clearly displayed, the charge may be unenforceable.
  • Incorrect details: Errors on the ticket (wrong date, time, location, or registration).
  • Grace periods: Many car parks must give a 10-minute grace period. If you overstayed by just a few minutes, challenge it.
  • Machine faults: If the parking meter was broken and you couldn't pay.
  • You weren't the driver: For private charges, the registered keeper can sometimes argue they weren't driving.

Around 50% of parking fine appeals are successful. It's always worth trying if you have a genuine reason.

Tips to Avoid Parking Fines

  • Always read the signs before parking
  • Set a phone alarm if you're in a time-limited space
  • Take a photo of your parking ticket displayed in the windscreen
  • Use parking apps (RingGo, PayByPhone) to extend time remotely
  • Never park on double yellow lines, even for "just a minute"
